Dismissed Possession of substance
Man stopped on Interstate 80 with almost 100 pounds of marijuana/THC cartridges has case dismissed due to the unconstitutional stop, illegal detention, and illegal dog sniff of the vehicle.
  • Penalty Reduced Felony Burglary & Criminal Mischief

    Defendant was looking at 15 years in prison for two felonies. Attorney able to poke holes in the State’s case and work out a plea agreement to where the defendant would plead to a simple misdemeanor trespass charge and serve no jail time.

    Defendant drives over curb and blows above .19 in the datamaster. Defendant gets case dismissed due to unconstitutional stop.

  • Not Guilty Patient Abuse
    Nurse accused of abusing patient at healthcare facility. Jury found the alleged victim not credible and therefore returning a verdict of not guilty.
  • Penalty Reduced OWI

    In 2016, Defendant had at least ten prior OWI’s and attorney was able to successfully argue to the judge that the defendant should receive the minimum of 30 days in jail and allow him the chance to get the proper treatment. As of 2019, the defendant has not received any new OWI’s.

  • Case Dismissed Possession of Controlled Substance

    Defendant was encountered by police and asked if he had anything illegal on him. The defendant said he had meth on him and handed the officer a cigarette box with the drugs inside. The State agreed to dismiss the drug charge because it also believed the search was unconstitutional.

  • Case Dismissed OWI second Offense and 3 counts of Child Endangerment

    In this case, the defendant was stopped by law enforcement after an anonymous tipster called into dispatch stating the defendant was intoxicated but the tipster had no first-hand knowledge that the defendant was actually intoxicated. The stop by law enforcement was ruled unconstitutional. 2020 case.

    Dismissed after unconstitutional stop of defendant's vehicle.

  • Not Guilty Theft

    Man with over one dozen prior thefts found not guilty of theft as he was heading toward the exit doors of a local grocery store with a cart filled un-bagged grocery items and no proof of purchase. Jury found the defendant not guilty because they concluded the defendant was still shopping yet.

    Officer stated in report that defendant swerved over center line at least one half-dozen times and had an unreadable license plate from 50 feet away. Attorney able to prove that the officer was not credible and the judge granted the defendant’s motion to suppress all evidence from the time of illegal stop.
